CHARLOTTE, N.C. โ Federal charges have been dropped against a Charlotte man who was accused of assaulting federal officers during Operation Charlotte’s web, a federal immigration enforcement operation in November 2025.
In late January, a federal grand jury indicted Miguel Angel Garcia Martinez for felony assault on federal officers conducting immigration enforcement operations.ย
This indictment came after a judge dismissed his original arrest and charges in November 2025.ย
The motion to dismiss the indictment without prejudice was submitted Monday, March 9.ย
Federal immigration agents originally arrested and charged Garcia Martinez after they saw him documenting their operations on Nov. 16. When agents approached Garcia Martinez, he left in his van, which led to a chase. Agents eventually boxed in his car and captured him.ย
DHS claimed he “weaponized his vehicle” and rammed into federal immigration cars.ย
His arrest caused protestsย in Charlotte, many citing video evidence that pointed to the opposite claim, that Garcia Martinez was avoiding federal vehicles as he drove.ย
A judge dismissed these charges on Nov. 27, 2025.ย
Months later, U.S. Attorney Russ Ferguson announced the January indictment. WCNC has reached out to Ferguson for comment on the dismissal.ย
