
The Supreme Court struck down the president’s global tariffs in a ruling last week.
WASHINGTON โ FedEx filed a lawsuit Monday seeking a full refund for President Donald Trump’s emergency tariffs, which the Supreme Court struck down last week.
The lawsuit filed in the U.S. Court of International Trade lists U.S. Customs and Border Protection and the agency’s commissioner, Rodney S. Scott, as defendants.
“Plaintiffs seek for themselves a full refund from Defendants of all IEEPA duties Plaintiffs have paid to the United States,” the lawsuit says, referring to the 1977 International Emergency Economic Powers Act, which Trump used to impose broad tariffs on almost every U.S. trading partner.
The Supreme Court struck down the tariffs on Friday, handing the president a stinging loss. The court ruled that the tariffs Trump imposed under an emergency powers law were unconstitutional.
Trump said he was โabsolutely ashamedโ of some justices who ruled 6-3 against him, calling them โdisloyal to our Constitution” and โlapdogs.”
FedEx did not specify a dollar amount that it’s seeking in the lawsuit.
U.S. Customs and Border Protection said in a bulletin that the tariffs imposed under IEEPA will no longer be in effect after midnight EST Tuesday.
Also on Monday, a trio of Senate Democrats called for the government to start refunding roughly $175 billion in tariff revenues after the Supreme Court ruling.
Sens. Ron Wyden of Oregon, Ed Markey of Massachusetts and Jeanne Shaheen of New Hampshire were unveiling a bill that would require U.S. Customs and Border Protection to issue refunds over the course of 180 days and pay interest on the refunded amount.
The bill is unlikely to become law, but it reveals how Democrats are starting to apply public pressure on the Trump administration.
Trump on Monday threatened countries around the world to abide by any tariff deals they agreed to, despite the Supreme Court ruling. He said he wants a global tariff of 15%, up from 10% he had announced immediately after the ruling.
