In the end, it was a group chat that did it for Arthur Tzaneros.

Hours after three students at Scots College had been charged with the gang rape of a 14-year-old girl, the former chief executive of freight giant ACFS Port Logistics sent a message to more than 100 old boys of the prestigious Bellevue Hill private school labelling the alleged victim a ā€œwilling participantā€. The accused boys, Tzaneros said, were ā€œdeadshitsā€, according to messages revealed by this masthead.

ā€œBefore anyone jumps to conclusions, this is no Skaf case,ā€ Tzaneros wrote, an apparent reference to notorious Sydney gang rapists Mohammed and Bilal Skaf.

Tzaneros deleted the messages after enquiries from this masthead and resigned less than an hour after the story was published, handing the reins to his father and co-founder Terry Tzaneros.

ā€œI deeply regret what I said, and for showing a complete lack of sensitivity to that situation,ā€ he said in a statement.

Tzaneros’ supporting role in the latest scandal to engulf Scots has thrust his billionaire family, notorious for guzzling up harbourside trophy homes in Sydney’s eastern suburbs, firmly into the spotlight. But it also threatens to blot out the very real crisis facing ACFS Port Logistics, which went into administration this month, owing nearly $300 million to creditors.

The company moves some 900,000 containers of freight from Australia’s ports to major retailers such as Coles, Woolworths and Bunnings, and its collapse has triggered fears in the logistics sector of a return to the supply chain gridlocks that frustrated consumers during the pandemic.

For now, the trucks are still running. But the company’s future may no longer lie in the hands of the father-son duo who founded it in 2005.

On Thursday, restructuring firm BDO, who have been appointed receivers, confirmed that they would be looking toward a sale process.

ā€œAs trading conditions continue to stabilise and the business returns to a more sustainable footing, focus will soon be turning towards a formal sale process,ā€ a spokesperson said.

ā€œEncouragingly, even before any sale campaign has commenced, the receivers have been approached by dozens of parties expressing interest in acquiring the business or its assets.ā€

The family, meanwhile, is determined to retain control of the business.

ā€œWe will keep the sites running and keep containers moving, with the receivers and the Tzaneros interests working in parallel to recapitalise the business,ā€ Terry Tzaneros said in a statement.

Whether they keep their logistics empire is contingent on the family convincing administrators Salea Advisory that they can come up with a deal to satisfy the company’s creditors better than any sale offer the receivers can get.

ā€œIt is the Tzaneros family’s absolute intent to ensure every one of you is paid in full through this process,ā€ Terry Tzaneros said in a note to suppliers this week.

But under Tzaneros’ management, those debts have blown out, with the company being pushed into administration after months spent in the crosshairs of creditors. In June, ACFS cut an eleventh-hour deal to avoid a wind-up order in the NSW Supreme Court brought by Transurban in July.

Separately, the Australian Taxation Office initiated its own wind-up proceedings in the Federal Court over debts then believed to be around $60 million. But that hearing was delayed until Friday after lender Scottish Pacific pushed the company into administration.

Documents filed with the Australian Securities and Investments Commission (ASIC) on Wednesday night revealed the scale of the ACFS debts. The company owes $290 million to around 60 creditors, including a $75 million debt to the ATO, $45 million to Scottish Pacific and $21 million to Daimler Truck Financial Services. It also owes $21.3 million to former staff.

ACFS has not filed accounts with ASIC since last May.

Despite the administration process, however, it remains business as usual for ACFS, and major retailers have confirmed that supply chains have not been impacted.

But some in the industry are worried. ACFS handles around 25 per cent of all shipping and logistics in Australia, and operates one of the few empty container parks in Australia, a critical part of the supply chain where containers are prepared for reuse.

ā€œWhether you’re an ACFS customer or not, keeping their empty container parks open is essential. If they shut, other facilities could quickly reach capacity, creating gridlock at major ports,ā€ said Paul Zalai, co-founder of the Freight and Trade Alliance, an industry body.

ā€œThe pandemic demonstrated the severe consequences when empty container parks reach capacity — containers are handled multiple times, truck queues escalate, port operations become congested and disruptions ripple across the entire supply chain,ā€ he said.

Before this week’s business and reputational troubles, the Tzaneros clan were best known for being entrenched in Sydney’s harbourside milieu, a feature of gossip and property columns. Arthur Tzaneros paid $61.5 million for a Bellevue Hill mansion in 2023 and last year sold a trophy home in Vaucluse for $41.5 million. Terry Tzaneros bought a $38 million Point Piper pad in 2021.

Arthur’s brother Anthony (who works as an IT director for the company) married Poppy O’Neil, daughter of property magnate Denis O’Neil, in an event described in these pages as Sydney’s society wedding of the year. That couple bought a Bellevue Hill palace for $25 million in 2023.

As the company has waddled under the weight of its debts, the Tzaneros family has maintained that luxurious lifestyle. Arthur’s wife, Maude Tzaneros, hosted a Valentine’s Day party this year aboard Mischief, the superyacht owned by billionaire garbage man Ian Malouf. Arthur Tzaneros has been spotted partying in the Greek island of Mykonos through the European summer.

This week, with the family’s control of the company under threat, Tzaneros has been responding to critical commentary on ACFS on social media. In a LinkedIn comment, he accused another industry figure raising concerns about the company’s creditors of being a ā€œkeyboard warriorā€.

ā€œYou can lead a horse to water, but you can’t make them drink it. In the meantime, hope your [sic] doing well,ā€ he said.
